Article 1 – Customer Acceptance of the General Terms and Conditions of Sale

All orders placed on the Champagne Terroir website are governed by the following General Terms and Conditions of Sale.

These terms are available to customers in the footer of every page on the site and must be fully read and accepted by the customer prior to any payment.

In return for this acceptance, Champagne Terroir undertakes to fulfill its obligations as described in these General Terms and Conditions of Sale.

Article 3 – Alcohol Sale Notice

In accordance with Article L.3342-1 of the French Public Health Code, Champagne Terroir prohibits the sale of alcohol to persons under eighteen (18) years of age through its website.
By purchasing on Champagne Terroir, the customer solemnly declares to be of legal age.

Excessive drinking is dangerous for your health – consume responsibly.
The consumption of alcoholic beverages during pregnancy, even in small quantities, can have serious consequences for the child’s health.

Article 4 – Prices

Unless otherwise stated, Champagne Terroir displays prices in euros, including all taxes (VAT and applicable excise duties for the destination country), but excluding delivery fees.

The price indicated in the order confirmation sent by Champagne Terroir is the final total price, including product cost, handling, packaging, and transport.

Champagne Terroir reserves the right to modify its prices at any time. However, the price confirmed in a validated order remains final.

For orders shipped outside mainland France, the customer acts as the importer of the goods.

For all products shipped outside the European Union or French overseas territories, prices are automatically calculated excluding taxes on the invoice.

Customs duties, import taxes, or other local charges may apply and remain the sole responsibility of the customer.

Article 5 – Legal Guarantees

In accordance with current legal provisions, the seller is liable for defects in conformity of the goods under Articles L.217-3 and following of the French Consumer Code, as well as for hidden defects under Articles 1641 to 1649 of the French Civil Code.

Legal guarantee of conformity (Articles L.217-3 to L.217-20 of the Consumer Code):

The consumer has two (2) years from the delivery of the goods to take action. They may choose between a refund or replacement of the goods, subject to the cost conditions set out in Article L.217-12. The consumer is not required to prove the existence of the defect of conformity within twenty-four (24) months following delivery.

Guarantee against hidden defects (Articles 1641 and following of the Civil Code):

The consumer has two (2) years from the discovery of the defect to act. They may choose between cancellation of the sale or a reduction in price, as provided for by Article 1644 of the Civil Code.

To exercise their rights, the Customer must inform the Seller in writing (by email or post) of the non-conformity or hidden defect as soon as it is discovered, at the following address:

Refunds, replacements, or repairs of non-conforming or defective products will be carried out as soon as possible, and no later than 14 days after the Seller confirms the defect.

These legal guarantees apply independently of any potential commercial warranty.

Only unopened products will be eligible.

Article 6 – Orders

When placing an order, the customer is responsible for the accuracy of the information provided (address, name, etc.). Champagne Terroir cannot be held liable if delivery is impossible due to an error in the customer’s information.

The sale shall only be considered final once full payment has been received. The Seller is not obliged to deliver the ordered products if the total price has not been paid.

Ownership of the goods will only be transferred after full payment, regardless of the delivery date.

Each order placed on the site is confirmed by email sent to the customer’s registered address. This confirmation includes the main details of the order and constitutes proof of the transaction.

In accordance with Article L.213-1 of the French Consumer Code, for any order exceeding €120, the Seller keeps an electronic copy of the contract for ten years from delivery.

The customer may request access to this archived contract at any time by contacting customer service.

Article 7 – Payment of Orders

Champagne Terroir offers several secure payment methods.

All transactions are processed through approved service providers using security protocols compliant with PCI DSS standards and the 3D Secure strong authentication system, in accordance with the European PSD2 Directive.

CREDIT CARD: CYBERPLUS PAYMENT

For payments by Mastercard/Visa, Champagne Terroir uses the Cyberplus Paiement solution, provided by Banque Populaire.

PAYPAL

Champagne Terroir also offers secure payment through PayPal. Your transaction is entirely protected by PayPal’s own security system.

Please note that your order will only be shipped once payment confirmation has been received from our bank.

For all payment methods, the payment is processed at the time of order.

Article 8 – Order Cancellation

Any order cancellation must be made before the order is shipped.

Cancellations must be requested by email from Champagne Terroir’s customer service at: contact@champagne-terroir.fr.

If cancellation occurs after shipment, the return costs will be at the customer’s expense.

Article 9 – Delivery

Unless otherwise stated, shipping costs are borne by the customer.

Champagne Terroir packages its products in custom-designed boxes for 1, 2, 3, 6, or 12 bottles.

Shipping takes place after payment and order validation by Champagne Terroir.

Orders are usually processed within 12 to 24 hours after payment, and delivery takes 1 to 5 business days, depending on the carrier selected.

In case of input error by the customer preventing delivery, the package will be returned to Champagne Terroir.

A reshipment may be arranged at the customer’s expense.

If the customer is absent at delivery, the carrier will leave the parcel at a designated location or pickup point. If not collected within the time limit, the parcel will be returned, and a new shipment will be possible at the customer’s expense.

When free shipping is offered by Champagne Terroir, this does not cover reshipment fees in case of return or error.

Risk transfer: The risk of loss or damage passes to the customer upon physical receipt of the goods by the customer or their representative. Until then, Champagne Terroir remains responsible for any loss or damage during transport.

If the customer selects their own carrier, responsibility transfers to the customer once the parcel is handed over to that carrier. In this case, the customer must deal directly with the carrier in case of dispute.

For professional clients, the transfer of risk occurs at handover to the carrier, even if transport was arranged and paid for by the seller.

In case of a damaged or opened parcel, the customer must refuse delivery and note the issue on the delivery slip.

Any anomaly (damaged parcel, missing product, etc.) must be reported within 14 days of receipt by email to contact@champagne-terroir.fr, including supporting evidence (photos, etc.).

Replacement (subject to availability) or refund will be processed within 14 days of receipt of the email.

Beyond this period, or if procedures are not followed, the products will be considered compliant and no claim can be accepted.

Article 10 – In Case of Disputes

The photos and product descriptions displayed on the Champagne Terroir website are for informational purposes only and are non-contractual.

As a result, the Seller cannot be held liable for any minor differences between the product presentation and the product delivered.

The Seller shall not be held responsible for any damage resulting from improper use or use not in accordance with the product’s instructions.

Furthermore, the Seller cannot be held liable for any non-performance or delay in performance caused by improper use of the products or by a force majeure event, as defined in Article 1218 of the French Civil Code and French case law.

In the event of a dispute, the customer is encouraged to seek an amicable solution by contacting Champagne Terroir’s customer service by email at contact@champagne-terroir.fr.

Claims and complaints will always be handled with care and attention.

In accordance with the provisions of the French Consumer Code concerning “the mediation of consumer disputes”, if no satisfactory response is received, the customer may refer the matter free of charge to the following consumer mediation service:

If no amicable solution can be reached, these Terms and Conditions are governed by French law, supplemented by European Union consumer law.

Consumers may bring a claim before either the French courts or the courts of their EU country of residence, in accordance with EU regulations.

Any dispute between professionals shall fall under the exclusive jurisdiction of the French courts (Commercial Court of the company’s registered office, unless otherwise expressly agreed).

Article 11 – Liability

To the extent permitted by law, the Seller’s liability is limited to the total amount paid by the Customer for the order concerned, except in cases of gross negligence or willful misconduct by the Seller.

The Seller shall not, under any circumstances, be held liable for indirect damages, including but not limited to:

Loss of turnover, profit, income, or business

Loss of customers or data

Loss of opportunity or business prospects

Commercial, financial, or reputational damage

Business disruption

Replacement or substitution costs

Any third-party claims against the Customer

This exclusion applies even if the Seller has been informed of the possibility of such damages, except in cases of gross negligence or willful misconduct.

The Seller’s liability shall not be engaged in the following cases:

Force majeure as defined in Article 1218 of the French Civil Code (an event beyond the Seller’s control, unforeseeable and irresistible)

Actions attributable to a third party outside the provision of the service

Improper use of the products by the Customer

Failure to follow instructions for use, maintenance, or storage

Normal wear and tear of the product

Unauthorized intervention on the product

The above limitations do not apply:

In cases of gross negligence or willful misconduct by the Seller

To legal guarantees (conformity and hidden defects) which cannot be excluded

In cases where the law prohibits limitation of liability

In such cases, the Seller’s liability shall be governed by the applicable legal provisions.

Article 12 – Right of Withdrawal

You have 14 days to exercise your right of withdrawal in accordance with current legislation.

Article 13 – Application of Modifications

Placing an order implies full and unconditional acceptance of these Terms and Conditions of Sale in the version in force at the time of the order.

Customers are invited to consult the CGV before each new purchase.

For ongoing contracts, modifications do not apply retroactively to orders already confirmed and paid, except in the following cases:

Mandatory legal or regulatory change, or

Modification favorable to the Customer

The language of these Terms and Conditions of Sale is French. In the event of a discrepancy between translations, the French version shall prevail.
